These Terms of Use constitute a legally binding agreement between you and MusicMarket Global. By accessing or using our services, you agree to be bound by these terms. If you do not agree, do not use our services.
1. Definitions
- "MusicMarket," "we," "us" refers to MusicMarket Global LLC, a Delaware company.
- "Services" means our AI-powered marketing, lead generation, and business optimization services.
- "Partner" means any instrument repair business subscribing to our services.
- "Guarantee" refers to our 10 qualified calls in 30 days promise, subject to terms below.
- "Territory" means the geographic area assigned to a Partner (typically city + 50km radius).
2. Service Description
MusicMarket provides AI-optimized digital marketing services specifically designed for instrument repair businesses, including but not limited to:
- Google Business Profile optimization and management
- Local SEO and citation building
- Review generation and reputation management
- Call tracking, recording, and qualification
- Landing page creation and optimization
- AI-powered content generation
- Performance analytics and reporting
3. The 10-Call Guarantee
3.1 Guarantee Terms
Our "10 qualified calls in 30 days" guarantee applies to Growth Partner Tier subscribers who:
- Complete onboarding within 7 days of signup
- Provide requested business information and access promptly
- Maintain active Google Business Profile in good standing
- Are located in an approved Territory (not oversaturated)
- Have not previously claimed the guarantee for the same business location
3.2 Definition of "Qualified Call"
A "qualified call" is defined as:
- Voice telephone call from human (not robocall)
- Caller explicitly seeking instrument repair services
- Caller located within Partner's designated Territory
- Call duration exceeds 60 seconds OR results in appointment booking
- Not a wrong number, solicitation, or spam call
- Not from another marketing agency or competitor
3.3 Guarantee Remedy
If fewer than 10 qualified calls are delivered in the first 30 days, Partner receives:
- Second month of service at no charge ($997 value)
- Continued optimization during month 2
- Strategy adjustment consultation
Guarantee does NOT include cash refunds. Maximum remedy is one free month.
4. Country-Specific Terms
🇺🇸 United States
Governing Law: Delaware law (where MusicMarket Global LLC is incorporated). Arbitration: Disputes resolved via binding arbitration in Spokane, WA per AAA rules. Class Action Waiver: You waive right to class actions. Tax: Partners responsible for all applicable state and federal taxes.
🇨🇦 Canada
Governing Law: Province of Ontario law for Canadian customers. Language: Les parties ont exigé que le présent contrat soit rédigé en anglais. Tax: GST/HST added to all invoices. Cooling-off: 10-day cancellation right for remote contracts under Ontario law.
🇬🇧 United Kingdom
Governing Law: England and Wales law. Consumer Rights: 14-day cooling-off period for consumers (not B2B). ADR: Alternative Dispute Resolution available via CEDR. VAT: 20% VAT added to all services. Data: UK GDPR compliance required.
🇦🇺 Australia
Governing Law: New South Wales, Australia law. Consumer Guarantees: ACL consumer guarantees apply where applicable. Security: MusicMarket maintains $2M professional indemnity insurance. GST: 10% GST included in quoted prices.
🇳🇿 New Zealand
Governing Law: New Zealand law. Consumer Act: Consumer Guarantees Act 1993 applies. Privacy: Privacy Act 2020 compliance. GST: 15% GST included in all prices.
🇰🇪 Kenya
Governing Law: Kenya law. Courts: Nairobi courts have exclusive jurisdiction. Data: Data Protection Act 2019 compliance. Currency: KES pricing available with hedging protection. M-Pesa: Mobile payment processing fees borne by Partner.
🇳🇬 Nigeria
Governing Law: Federal Republic of Nigeria law. Courts: Lagos State High Court jurisdiction. Tax: 7.5% VAT and 10% withholding tax obligations. Forex: USD pricing with NGN conversion at CBN rate. Data: NDPR compliance required.
🇦🇪 UAE
Governing Law: UAE law (DIFC or ADGM if applicable). Language: Arabic translation available upon request. VAT: 5% VAT added. Licensing: Partner must hold valid UAE trade license. Sharia: Islamic finance principles available for revenue-share arrangements.
5. Payment Terms
- Growth Partner Tier: $997 USD/month (or local currency equivalent)
- Billing Cycle: Monthly, charged in advance on 1st of each month
